Ticketing Terms and Conditions
All sessions are 18 years and over for unclassified films in accordance with Classification guidelines. This policy is strictly adhered to. Refunds will not be given for tickets purchased, or which are attempted to be used, contrary to this policy and those guidelines.
By submitting your order, or purchasing at a Festival Ticket Outlet, you are indicating that you have read and accept these CinefestOZ Terms and Conditions, which may change. All orders are subject to payment of full fare, credit card approval and billing address verification.
ADMISSION TO EVENTS AND VENUES
All persons seeking admittance to an event or session must have a valid ticket, irrespective of their age. Seat numbers are not allocated or indicated on tickets. However, for some cinema sessions, seats have been allocated and reserved by the Festival, and staff will seat guests on entry. Latecomers will be admitted at the discretion of staff or volunteers.
CinefestOZ reserves the right to deny any person admission to any Festival Managed Venues or session.
BOOKING FEES
A booking fee applies for transactions made online, via phone or at a Festival Ticket Outlet, as below:
$0.01 – $20.00 = $1.50
$20.01 – $60.00 = $2.50
$60.01 – $200.00 = $3.50
>$200.00 = $4.00
Passes will be charged a booking fee at the time of the original purchase but are exempt from booking fees when redeeming general screenings and the total is $0.00 when checking out. If the pass holder has purchased additional single tickets in the same transaction, then the booking fee applies to those tickets only.
COMPANION CARDS
A valid Companion Card or valid Companion Card Number must be produced at the time of the booking to gain access to the Companion Card Scheme offer. Details of use are on the COMPANION CARD WEBSITE
For bookings made online via the CinefestOZ website please EMAIL US with details of the tickets purchased to enable a Companion Card ticket to be issued for the same session/s. CinefestOZ accepts a range of concessions to ensure the Festival is accessible to all. We offer concession tickets for general screenings and some events (where listed) to full-time students, pensioners, unwaged people and seniors. A current and appropriate ID or concession card must be presented when buying or collecting tickets and, if requested, on entry to the venue, always to the satisfaction of Festival staff and Movie Crew volunteers.
COPYRIGHT
The use of cameras, phones or other devices for the purposes of recording any copyright protected material in any way in any Festival sessions or Events is strictly prohibited. Security personnel may be in attendance to prevent illicit recording. If a person is believed to have been so recording illegally they will be immediately removed from the venue and the recording device may be confiscated. No refund will be provided. Further action may be taken against the individual/s found to have breached copyright or the restrictions in these Terms.
DISCOUNT CODES
Discount codes are valid to be used on the following ticket types and can be used more than once. Excludes Family of four (4) ticket type as this is already discounted and excludes all other events. Expiry date: 8 September 2025.

PASSES/CINEPASSES
CinefestOZ Cinepass’ are non-transferable, valid only for the named holder, and entitle the holder to one (1) ticket per session/event per Cinepass. Cinepass’ may include access to screenings, events, and experiences as outlined in the Cinepass descriptions, yet are subject to availability and venue capacity.
Passholders may be required to pre-book sessions that have high demand as they may sell out, depending on venue capacity limits. Therefore, advanced online bookings are recommended. Passholders maybe asked to present valid photo ID for pass collection and entry to events.
All sales are final, no refunds or exchanges for change of mind, partial use, or missed events. CinefestOZ may make changes to the program as needed and kindly asks all guests to respect the festival experience for others. While we aim to make every event enjoyable and safe, attendance is at your own discretion and risk.

PHOTOGRAPHY
By purchasing a ticket or attending a free event, you acknowledge and agree that you may be photographed or recorded on video. These images and videos may be used for promotional, marketing, or other purposes by the event organizers and associated partners. Your purchase and presence at the event signifies your consent to this waiver.
If you have any concerns or wish to opt out of being photographed or recorded, please contact our ticketing team prior to the event or inform the photographer and/or videographer at the event.
GIFT VOUCHERS
Gift Vouchers are treated as cash and cannot be replaced if lost or stolen. Vouchers can be used to redeem products sold via the ticketing channels only. Vouchers cannot be redeemed for events ticketed by external venues. Vouchers cannot be used for any other purchases (including without limitation, candy bar purchases or any purchases from organiser partners and/or sponsors) unless expressly specified.
Vouchers cannot be returned or exchanged (whether in whole or in part) for cash. The value stated on the voucher (or remaining on the voucher after partial redemption) is expressed inclusive of GST. Any purchases which exceed the value of the gift voucher will require the holder to pay the difference in price using another form of tender. Any balance that remains on the voucher after expiry (3 years from purchase) will not be available for any use.

EXCHANGES AND REFUNDS
Single Ticket Purchases: All single tickets are non-refundable but can be exchanged for tickets of the equal dollar amount or more, with the value of tickets already paid to be used as credit towards a ticket of a higher dollar amount, and the difference in amount to be paid immediately by you. Any dollar amount difference will not be refunded. Exchanges can occur before the session start time at a CinefestOZ Ticket Outlet or via online customer accounts. Single ticket exchanges are subject to availability. Credit card charges are non-refundable.
Special Events: No exchange or refund is offered on Special Events, including Busselton Premieres, In Conversation events.

SOFTWARE FERVE
CinefestOZ uses software provider FERVE to sell tickets and you may see their name on your bank statement after a purchase. By agreeing to our Terms & Conditions, you also agree to Ferve’s TERMS & CONDITIONS.
VARIATIONS AND AMENDMENTS
Particulars of the session or event may be changed without prior notice. Films, artists or performers may be added, withdrawn or substituted for specific performances or sessions. No refunds will be available in these instances, except as set out in these Terms or at the discretion of the Festival, however exchanges may be permitted, solely as set out above. CinefestOZ may vary these Terms and Conditions at any time, which will be binding on all ticket or Pass holders. CinefestOZ will post the varied Terms and Conditions on its website.

Definitions
Our, We, Us - is Ferve Tickets Pty Ltd (ABN 41 074 903 085) which includes our related entities, directors, officers and agents of 27/296 Bay Rd, Cheltenham VIC 3192 Australia
Website - the website where you will view events and purchase tickets, usually a subdomain of ferve.tickets.
Services - the browsing, selection and purchase and delivery of event tickets and related items; management of bookings, tickets and other personal information.
Your agreement to these terms

Services Provided
We operate and maintain a secure website and service for the sale of tickets, passes, merchandise, gift vouchers, membership, and in certain conditions, donations, for Event Organisers.
We supply payment processing, ticket generation, and other services to facilitate the sale of tickets for Event Organisers.
Acceptable use of Services
You agree that you will use the Website and Services provided only for their intended use, and will not abuse, disrupt, or otherwise interfere with the operation of the Service, nor engage in any illegal activity by using the Service, including hacking into the website or disrupting service by repeatedly requesting pages or content, nor use bots, spiders or other automated systems to either purchase or disrupt the purchase of tickets.
Payment Processing
All payments are processed through secure card payments systems by Ferve Tickets Pty Ltd. For further information please see our Privacy and Security policy located at
https://ferve.tickets/event-ticketing-by-ferve-tickets/. Ferve Tickets is responsible for card purchases, refunds on event cancellations, card statement enquiries, and chargebacks.
Each ticket you purchase on this website may be subject to fees and charges which are non-negotiable and non refundable in the event of a refund or cancellation. All prices are stated in the currency applicable on the checkout where you are entering your card details.
Event Variations
We cannot offer any compensation or be liable in any way for events which have any variation (including postponement) from that which is described by the Event Organiser during the on sale period. In this case you should contact the Event Organiser to discuss your concerns.
Refunds
Refunds may be allowed by the Event Organiser and/or under Australian Consumer Law (if applicable). Please contact the Event Organiser to discuss your specific circumstances for a refund as any obligation for a refund rests solely with the Event Organiser. You agree that when applicable, booking fees or other surcharges for processing tickets to the original purchase are not refundable, and are a cost of supplying the Services, including the refund.
Cancellations
Where an event is cancelled, you are entitled to a refund. When we are notified by an Event Organiser that an event is cancelled, we will work with that Event Organiser to ensure that all tickets are promptly refunded. This should be within 2-3 business days of when the event is cancelled by the Event Organiser. Once your refund is processed normal credit card processing for refunds apply, which means it may take another 3-5 business days for the refund to show on your card statement. If a refund fails to appear on your statement after that time, please contact us. If we believe the refund has been processed successfully, then you will then need to speak to the issuer of your card in order to chase up the refund.
Exchanges
Exchanges of tickets may be permitted by the Event Organiser, either via self exchange on our website or via an assisted exchange over the phone.
In such a case you agree to pay any fees associated with the exchange of tickets, and that the tickets to the original event or other items purchased become null and void at the time the exchange is processed.
Intellectual Property
You agree that the System and all non third party content contained within it is our intellectual property and is owned or licenced by us.
You will refrain from copying, modifying, re-publishing, iframing, distributing or communicating any part of the Website or Services or information contained within in any way that may infringe our intellectual property. You are given permission to download or access content as part of the normal operation of this Website and Service.
Third Party Content
Event organisers may link to or incorporate third party content in event descriptions, images or other parts of the System. This third party content is provided ‘as is’, without any warranties as to the suitability of the content, or its legal use. You indemnify us against any action for the use of third party content by an Event Organizer or other party.
Reselling or Scalping Tickets
Reselling or scalping tickets from this website is expressly prohibited and will result in termination of your access to the Services and potential legal action.
Should you wish to refund tickets please contact the Event Organiser to discuss your circumstances for a refund rather than attempting to resell tickets.
Termination of services
We may terminate or suspend your rights to use the Services we provide at any time if you breach these terms, if you misuse or abuse the Services, including for any illegal activity, or if your use of the Services would expose us to legal liability.
Inconsistency, Severability and Survival of Terms
If an Event Organiser Terms and Conditions are in conflict or inconsistent with these Ferve Terms and Conditions, then these Ferve Terms and Conditions will prevail over the Event Organiser conflicting or inconsistent terms.
All other provisions of these terms continue to survive in the case of any severability of a specific term, or the termination of your use of the Services.
Liability and Indemnity
Our entire liability (including us and our related entities, directors, officers and agents) to you will be, to the maximum extent permitted by law, be limited to the fees you have paid us as booking fees, but not including credit card surcharges, which may be added depending on the organizer, for a period of not more than the preceeding 12 months. This includes for any loss or damage including direct, indirect, special or consequential loss, in tort (including if we are negligent), arising from your use of or inability to use the website or Services we provide.
Under Australian Consumer Law (when applicable), we limit the remedies available to you to the cost of supplying the services again, or supplying the services again.
Force Majeure
Where we are unable to provide services because of a force majeure event, for example, fire, flood, loss of connectivity or banking network outage, terrorist attack or war, act of God, or other disruption or disaster, we are not responsible for failure to fulfil any obligations under this contract.
Governing Law
This agreement will be governed by the laws of the State of Victoria, Australia.
